    A. Terms & Conditions for Individual Users

    For the purposes of this website, these terms are made between “PROFOUND PORTAL", a company having Trade Licence issued by the Department of Economy and Tourism in the Emirates of Dubai, UAE (“we” “us” “ our ”, the “Company”, “ www.alsayaarat.com” as applicable) and you (“you ” or the “ User ”). Website refers to www.alsayaarat.com and PROFOUND PORTAL operates this website. 

     

    1. By accessing alsayaarat.com website, you are confirming and agreeing to be bound by this website’s “Terms and Conditions” of use, applicable laws and regulations and agree that you will comply with the rules of this website and responsible for compliance with any local laws. If you do not accept or agree to comply with these Terms, you must not use this Website. These terms and conditions are subject to revision by Alsayaarat, at any time without notice.
    2. “We” are not car dealership company. We provide services which facilitates individual car owners and Car dealers to market, advertise, list or display their products and you may be able to view the details and prices of the displayed products, contact, enquire about the same directly with them. Likewise, you can also market, advertise, display or list your individual vehicles on alsayaarat.com by creating your individual account or profile.
    3. We are not responsible to preparing the details and we do not get involved in any communications between you and dealers and individual car owners and do not participate in any transaction or putting the price for the items displayed on alsayaarat.com
    4. We host the details in good faith which are produced directly for each product displayed on this site by the dealers and individual car owners. You are responsible for making complete inquiries, checking, confirming the accuracy and satisfying yourself with the completeness and legal advice, relating to the product, before committing any transactions. You are also required to act in good faith with other parties.
    5. In no event, “we” shall be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on www.alsayaarat.com website, even if www.alsayaarat.com or any of its authorized representative has been notified orally or in writing of the possibility of such damage.
    6. There could be errors (like technical, typographical, or photographic) on material appearing on alsayaarat.com. We do not warrant that any of the materials posted by dealers or individual car owners on the web site are accurate, complete, or current. www.alsayaarat.com may make changes to the materials contained on its web site at any time without notice.
    7. This website or its services are subject to necessary maintenance or upgrade. In that event, services will be interrupted, though we strive to ensure that our website and the Services are available to you at all times but cannot guarantee that either the website or the Services will operate continuously, without interruptions or be fault free and aim to keep downtime to a minimum extent possible. We accept no liability for any interruption or loss of service. We reserve the absolute right to alter, suspend or discontinue any part of our website or the Services, including your access to it.
    8. This website may contain links to third party products, services, websites that may not be affiliated with alsayaarat.com. Accordingly we take no responsibility for these third party products, services, websites. Any links or third party advertisements on our site are sole responsibility of the advertiser and we are not responsible for any misleading or inaccurate information for this.
    9. Any claim relating to alsayaarat.com web site shall be governed by the laws of the UAE.

    Packages, Fees and Payment

    1. Payment is to be made online in advance as per the subscription selected. For free subscription, no fee will be charged. Fee will start from the date of starting the service on. Fee to be paid through online transfer only.
    2. The Service will not be activated until full payment has been provided as above.
    3. We offer a number of different packages that vary in terms of price and services included. Users may subscribe to any of these packages but switching, or addition of special conditions to, packages is at our sole discretion. We reserve the right to amend the terms and conditions of this Agreement, including package components and fees, at any time. You will be given notice of any changes to our fees or package components.

    Refund Policy

    1. The user has the right to a refund under the following circumstances:
      1. if a duplicate payment is received for an already paid for service, the duplicate portion of the payment will be fully refunded.

    Return of Goods

    1. The user has to clearly specify whether return is applicable on the listed item or not. www.alsayaarat.com only acts as a mediator between the seller and the buyer and in no way facilitates the return of the goods displayed or sold through the site.

     B. Terms & Conditions for Car Dealers

    For the purposes of this website, these terms are made between ““PROFOUND PORTAL", a company having Trade Licence issued by the Department of Economy and Tourism in the Emirates of Dubai, UAE (“we” “us” “ our ”, the “Company”, “ www.alsayaarat.com” as applicable) and you (“you ” or the “ User ”). Website refers to www.alsayaarat.com and PROFOUND PORTAL operates this website.

    “You”, “Your”, “Yours”, “Car Dealers” or “the Client” refers to the individuals and the users of services through website (“the service”).

    Services include usage of

    • Dealership Management program
    • Display of products on this website
    • Online marketing campaigns for your products by alsayaarat.com
    • Inclusion of your products in e-mail alerts

     

    1. By signing an Agreement with PROFOUND PORTAL by you, it will constitute that you had read the terms and conditions and are accepting these terms and conditions along with the Listing Agreement.
    2. Display or list your vehicles that are currently available for sale from your end and as per the package selected by you.
    3. Ensure that material you generate through use of the Service is not unlawful or for an improper purpose, including information that is defamatory, misleading or deceptive, in breach of copyright or would otherwise expose us to any liability, legal proceedings or other sanction.
    4. Ensure that you do not make, arrange or authorize the insertion of any reference to us or our web site in any document (including promotional or merchandising material) or on any web site other than our web site without our prior written consent
    5. Abide by any applicable rules and regulations related to electronic truncations and commerce
    6. In your use of the Service, comply with all applicable laws.
    7. Not make any promotional or merchandising reference to us or our web site without our express written permission.
    8. Within 24 hours of a sale contract being entered into for a vehicle mark that vehicle as sold on the web site;
    9. Any reference to material other than listing details for a vehicle must receive our written approval prior to your submission;
    10. Ensure that no other person, authorized or otherwise, makes use of your subscription to the Service in breach of these terms and conditions;
    11. Not make any promotional or merchandising reference to us or our web site without our express written permission.
    12. By using the Service, you grant us an irrevocable, world-wide, royalty free license to commercialize, copy, license to other persons, use and adapt for any purpose any material you generate or submit to make use of the Service;
    13. We are not under any obligation to monitor or censor the material generated by users of the Service that appears on our website, however we reserve the right to do so;
    14. We are not responsible for the Service's content or for any errors or omissions in any vehicle data provided by or on behalf of you;
    15. You are responsible for updating your listings to follow www.alsayaarat.com image guidelines, we reserve the right to penalize any images content we deem unfitting;
    16. Systems or technological failure may impede or prevent access to all or any part of the vehicle data;
    17. You are responsible for and must pay the cost of all telecommunications and Internet access charges incurred when using our website, whether or not such access has been arranged by us;
    18. You are responsible for the security and integrity of your data;
    19. Transmission of data over the Internet can be subject to errors and delays;
    20. We will contact you from time to time to make you aware of opportunities, products and services offered by us and our business partners. You authorize us to contact you via email, SMS, MMS and other electronic media for that purpose unless you explicitly request us not to contact you via these media.

    Agreement Term, Suspension or Termination of Service

    1. Our agreement with you is on monthly basis. If you are not satisfied with the services, you can unsubscribe from our services before the close of the month.
    1. Without limiting our other rights, we may immediately suspend the Service and/or temporarily remove details of any vehicle uploaded by you to our web site and/or terminate this Agreement if:
      1. You fail to pay any fees or charges due to us by the due date in the form of online payment/ cash or Cheque;
      2. Any material supplied by you is false or misleading;
      3. You enter into bankruptcy, liquidation, administration, receivership, a composition of arrangement with your creditors, or appoint a receiver or manager over all or any part of your assets or become or are deemed to become insolvent; or
      4. You die, or if you are in a partnership, are dissolved or an application to dissolve is filed, or if you are a company, are wound up or an application for winding up is filed.

    Packages, Fees and Payment

    1. Payment is to be made online in advance for the month as per the subscription selected. For free subscription, no fee will be charged. Fee will start from the date of starting the agreement with PROFOUND PORTAL or alsayaarat.com. Dealers can request for making payment is cash or cheques if they find it difficult to pay through online transfers.
    2. The Service will not be activated until full payment has been provided whether in Cash, credit card payments, or post dated cheques or other forms of payment as stipulated by the Agreement.
    3. The client is liable for the costs incurred in this Agreement from the Contract Start Date whether or not the service is active.
    4. The current fees for the Service are specified in the Agreement. We offer a number of different packages that vary in terms of price and services included. Dealers may subscribe to any of these packages but switching, or addition of special conditions to, packages is at our sole discretion. We reserve the right to amend the terms and conditions of this Agreement, including package components and fees, at any time. You will be given notice of any changes to our fees or package components.

    Closing of Account

    Please review this important account closure guidance. Specifically:

    • Agreement termination: Closing your account will serve as your notice of termination of the Alsayaarat Customer Agreement (or any other agreement governing this account) for this account.
    • Billing: You remain responsible for all outstanding fees and charges, incuding this month's usageand active subscriptions
    • Reactivation: You may reopen your Alsayaarat account for 90 days after closure. If you reopen your account, you may be charged for any active After 90 days your account will be permanently closed, any remaining content will be deleted.

    Refund Policy
